The reconstruction of facts and the experiment of instruction: legislative enhancement

Since the approval in 2019 of the new Constitution of the Republic of Cuba, after a broad debate with the people, and by command of the thirteenth transitory provision of the Magna Carta itself, the National Assembly of People's Power approved a legislative schedule that guarantees the development of the precepts established in the Magna Carta. Among the legal bodies approved in compliance with this constitutional mandate are the Criminal Procedure Law and the Military Criminal Procedure Law, which, as part of their novelties, regulate with greater scientific and legal rigor the investigative actions known as reconstruction of the facts and investigative experiment. The objective of this research is to show the advances achieved in the legal instrumentation of the actions of instruction of reference in the Republic of Cuba. In order to reach the foreseen objective, the historical-logical, legal-theoretical and exegetical methods were used, as well as the research techniques document analysis. The contributions of the new laws, in the scientific, legal and methodological order, to the understanding and application of the reconstruction of facts and the investigation experiment and the guarantee that this provides in terms of achieving greater coherence and legal certainty, as essential elements for strengthening the rule of law.
